Quick context and a short history: Do Not Disturb on an iPhone can be affected by its settings (exceptions, scheduled times) or by an OS-level problem. In iOS 6 there was a widely reported scheduling fault that left Do Not Disturb stuck on after the New Year; Apple acknowledged it and advised switching scheduled DND off until the issue corrected itself the week of January 7, 2013. (macrumors.com)

Practical checklist (quick to run through):

  • Confirm DND is actually active: look for the crescent-moon indicator in the status bar or Control Center so you know the phone thinks it’s silenced. (macworld.com)
  • If you used Scheduled times, temporarily disable scheduling (Settings → Notifications → Do Not Disturb) and test manual on/off behavior — that was the Apple-recommended workaround during the iOS6 scheduling problem. (macrumors.com)
  • Check exceptions: review Allow Calls From and remove any group or Favorites entries you don’t want bypassing silence; also toggle Repeated Calls if you don’t want a second call within ~3 minutes to ring. Test by calling once, then calling again within a few minutes to see if it breaks through. (macworld.com)
  • Reboot the phone after changing settings. If problems persist, update the device (iOS 6.1 was released Jan 28, 2013) or restore from a backup — some DND issues were resolved by OS updates, though major updates occasionally had unrelated carrier issues to be aware of. (apple.com)

Thanks to points raised earlier by and — the above expands on exceptions and the specific iOS6 scheduling glitch so readers can isolate configuration problems from the one-off system bug. If the checklist doesn’t help, contact Apple Support or post device logs/screens to follow up. (support.apple.com)

Do not disturb must be turned ON for something to happen. All it does is prevent a "notification", be that a vibration or sound, from being emitted. When it is turned OFF the phone functions as it normally would.

If its off it does nothing. If it's on make sure you have no body is somehow on your favorites, because people on your favorites will bypass the do not disturb feature
